1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Auburn Porta Potty ("Company," "we," "our," or "us") regarding your use of our portable toilet rental services. By renting equipment from us, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use our services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on our website.

2. Services Provided

Auburn Porta Potty provides portable toilet rental services including:

  • Standard portable toilets
  • Deluxe portable toilets with hand sanitizer dispensers
  • ADA accessible portable toilets
  • Luxury restroom trailers
  • Handwashing stations
  • Delivery, setup, and pickup services
  • Regular maintenance and cleaning services

All services are subject to availability and our standard operating procedures.

3. Rental Terms and Pricing

Rental Periods

  • Standard rental period is one week (7 days)
  • Weekend rentals available (Friday delivery, Monday pickup)
  • Long-term rentals available with discounted rates
  • Same-day delivery available for orders placed before 2:00 PM

Pricing

  • Prices are subject to change without notice
  • Quotes are valid for 30 days from issue date
  • Additional fees may apply for difficult access locations
  • Emergency delivery fees may apply for rush orders
  • All prices exclude applicable taxes

Payment Terms

  • Payment is due upon delivery unless credit terms have been established
  • We accept cash, check, and major credit cards
  • A 1.5% monthly service charge applies to overdue accounts
  • Returned checks subject to $35 fee plus bank charges

4. Customer Responsibilities

Site Preparation

  • Provide safe, level ground for unit placement
  • Ensure adequate access for delivery and pickup vehicles
  • Clear the delivery area of obstacles, vehicles, and debris
  • Provide accurate directions and contact information
  • Obtain necessary permits if required by local authorities

Proper Use

  • Use units only for their intended purpose
  • Do not dispose of inappropriate materials (feminine products, diapers, cigarettes, etc.)
  • Do not move or relocate units without authorization
  • Report damage or vandalism immediately
  • Ensure units are accessible for service visits

Security and Supervision

  • Customer is responsible for security of rented equipment
  • Provide adequate supervision at events to prevent misuse
  • Report theft, vandalism, or damage immediately
  • Customer assumes liability for equipment while in their possession

5. Delivery and Pickup

Delivery

  • Delivery times are estimates and may vary due to traffic, weather, or other factors
  • Customer must be available to receive delivery or designate an authorized representative
  • Delivery location must be accessible by standard delivery truck
  • Additional charges apply for difficult access or special placement requests

Pickup

  • Units must be accessible for pickup at scheduled time
  • Customer responsible for ensuring units are empty and ready for pickup
  • Additional charges apply if pickup is delayed due to customer factors
  • Extended rental fees apply if units are not ready for scheduled pickup

6. Maintenance and Service

  • Regular service includes cleaning, restocking supplies, and waste removal
  • Service frequency depends on rental duration and usage
  • Customer must provide access for scheduled service visits
  • Additional service visits available upon request for additional fee
  • Emergency service available 24/7 for urgent issues

7. Damage and Loss

Customer Liability

  • Customer is liable for damage to rented equipment beyond normal wear and tear
  • Customer responsible for replacement cost if equipment is lost or stolen
  • Damage charges based on actual repair or replacement costs
  • Customer liable for damage caused by improper use or negligence

Damage Assessment

  • Equipment inspected upon delivery and pickup
  • Customer will be notified of any damage charges within 5 business days
  • Photographic evidence provided for damage claims
  • Customer has right to dispute damage charges within 10 days

8. Cancellation Policy

  • Cancellations must be made at least 24 hours before scheduled delivery
  • Cancellations made less than 24 hours before delivery subject to 50% charge
  • No refund for cancellations made after delivery
  • Weather-related cancellations handled on case-by-case basis
  • Company reserves right to cancel rentals due to safety concerns

9. Limitation of Liability

Auburn Porta Potty's liability is limited to the rental fee paid by the customer. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits or business interruption
  • Personal injury or property damage not caused by our negligence
  • Delays in delivery or service due to circumstances beyond our control
  • Damage to customer's property during normal delivery and pickup operations

10. Insurance and Indemnification

Customer agrees to indemnify and hold harmless Auburn Porta Potty from any claims, damages, or expenses arising from:

  • Customer's use of rented equipment
  • Negligent acts or omissions by customer or their agents
  • Violation of applicable laws or regulations
  • Third-party claims related to customer's event or project

Customer is responsible for maintaining adequate insurance coverage for their event or project.

11. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from circumstances beyond their reasonable control, including but not limited to:

  • Natural disasters, severe weather conditions
  • Government actions, regulations, or restrictions
  • Labor disputes or strikes
  • Equipment failures or supply shortages
  • Public health emergencies

12. Governing Law and Disputes

These Terms are governed by the laws of the State of California. Any disputes arising from these Terms or our services shall be resolved through:

  • Good faith negotiation between the parties
  • Mediation if negotiation fails
  • Binding arbitration if mediation is unsuccessful
  • Jurisdiction in Placer County, California courts if arbitration is not applicable

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.

14. Entire Agreement

These Terms constitute the entire agreement between Auburn Porta Potty and the customer regarding portable toilet rental services. These Terms supersede all prior agreements, understandings, or representations, whether written or oral.
